Terms and Conditions of Providing Services - OPUS Hiring Platform
1. Introduction
Welcome to OPUS! These Terms and Conditions ("Terms") govern your access to and use of OPUS, available at opus.sa, the App Store, and Google Play. By using OPUS, you agree to these Terms. If you do not agree, please refrain from using our services.
2. Definitions
For the purposes of these Terms, the following definitions apply:
- OPUS – The job-matching platform available via opus.sa, the App Store, and Google Play.
- User – Any individual or entity accessing OPUS, including Job Seekers and Employers.
- Job Seeker – An individual searching for employment opportunities through OPUS.
- Employer – A company or individual using OPUS to post job openings and recruit talent.
- Account – A registered profile on OPUS that allows Users to access the platform's functionalities.
- Agreement – These Terms and Conditions, along with the Privacy Policy, governing the relationship between OPUS and its Users.
3. Acceptance of Terms
By downloading, installing, or using OPUS, you acknowledge that you have read, understood, and agreed to these Terms. If you do not accept these Terms, you may not use OPUS.
To use OPUS, you must:
- Be at least 18 years old.
- Provide accurate and truthful information when creating an Account.
4. Account Registration and Usage
Users must create an Account to access OPUS features.
- Each Account must be associated with a valid email or phone number.
- Users are responsible for maintaining the confidentiality of their login credentials.
- Employers must provide accurate company details and job postings.
- OPUS reserves the right to suspend or terminate any Account that violates these Terms.
5. Services Provided
OPUS connects Job Seekers with Employers through:
- Job Listings – Employers can post job opportunities.
- Profile Creation – Job Seekers can create and update their profiles.
- Application Management – Employers can review, shortlist, and contact candidates.
- Location-Based Job Matching – Job Seekers receive job recommendations based on their location.
6. Employer Branding and Marketing
By using OPUS, Employers grant OPUS the right to use their company name, logo, and publicly available job postings for marketing and promotional purposes, including but not limited to:
- Showcasing Employers on OPUS's website and mobile applications.
- Featuring Employers in advertisements, social media posts, and email campaigns.
- Including Employer logos in case studies, success stories, and promotional materials.
This right is granted to OPUS without the need for prior approval from the Employer and continues for as long as the Employer has an active account on OPUS.
7. User Responsibilities
Users agree to:
- Provide accurate and up-to-date information.
- Use OPUS only for lawful hiring or job-seeking purposes.
- Not post misleading, fraudulent, or inappropriate job listings or applications.
Employers must comply with labor laws and recruitment regulations. OPUS is not liable for disputes between Job Seekers and Employers.
8. Payment and Refund Policy
Certain OPUS services may require payment. By purchasing a paid service, you agree to the pricing and payment terms displayed at the time of purchase.
- Payments are processed through App Store, Google Play, or direct payment gateways.
- Refund requests are handled in accordance with applicable laws and OPUS's refund policy.
- Subscriptions automatically renew unless canceled before the renewal date.
9. Privacy and Data Protection
Your personal data is handled according to the OPUS Privacy Policy. By using OPUS, you consent to the collection, storage, and processing of your data for job-matching purposes.
Employers must ensure they handle Job Seekers' data responsibly and comply with applicable data protection laws.
10. Restrictions on Use
Users may not:
- Share false, misleading, or incomplete information.
- Use OPUS for any illegal, fraudulent, or discriminatory activities.
- Violate intellectual property rights or engage in spamming.
- Attempt to manipulate OPUS algorithms or misuse the platform.
Violating these restrictions may result in Account suspension or termination.
11. Service Availability and Liability
OPUS strives for 100% uptime, but does not guarantee uninterrupted access.
- OPUS is not responsible for job offers, hiring decisions, or workplace conditions.
- OPUS is not liable for any financial loss, employment disputes, or legal matters between Employers and Job Seekers.
12. Termination of Services
Users may delete their Accounts at any time. OPUS may suspend or terminate access if:
- A User violates these Terms.
- A User engages in fraudulent or harmful activities.
- Required by law or regulatory authorities.
13. Amendments to These Terms
OPUS reserves the right to modify these Terms. Users will be notified of significant changes via email or in-app notifications. Continued use after changes implies acceptance of the new Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Saudi Arabia. Any disputes arising from the use of OPUS shall be resolved in Saudi courts.
